Effective date: 01/01/2023

Unless otherwise stated in these User Terms and Conditions of Service, a Term used within them has the same meaning as it has in Our General Terms and Conditions of Service.

1. Introduction

Munchies4You (PTY) Ltd. is a company registered in the Republic of South Africa under the registration number 2024/270421/07 and are the owners and operators of the Domains that constitute The Platform.

Together, Our Terms and Policies govern all use of The Platform and constitute Your agreement with The Company pertaining to Your use of The Platform. The Company reserves the right, in Our sole discretion, to change the Terms and Policies or any parts thereof at any time without prior notice or justification. Please note the effective dates at the top of the Terms and Policies to see when they were last revised. Any changes will become effective when they have been published. You are thus encouraged to review all the Terms and Policies at the inception of each session, as You will be deemed to have accepted any changes if You continue to use The Platform after such changes have been published. Should You disagree with any revisions to the Terms and Policies, You may terminate the agreement immediately as provided in the Terms and Policies.

2. The Company’s Services

The Company runs a self-service Platform that allows Members to interact by supplying and acquiring various Listings.

Being a self-service Platform, the onus is always on You to define and supply the correct information during Your use The Platform as well as to assess the suitability of any Listings before ordering such a Listing. The Company may engage You via various communication methods and could even use The Platform on Your behalf, but the onus is still on You to make the final assessment of suitability and to check the accuracy of all information before finalising any orders.

3. Your Responsibilities

You understand and accept the responsibilities of using the self-service Platform offered by The Company. These responsibilities include, but are not limited to:

  • ensuring that the Listing supplied meets Your requirements;
  • checking and ensuring that the correct details have been supplied by You in the order process;
  • ensuring that any possible dietary requirements that may impact Your ability to make use of the Listing offered are met;
  • ensuring that any other factors that may influence Your ability to make use of and enjoy the Listing offered are met.

You warrant that You are authorised to and are making use of The Platform of your own free will.

4. Searching on The Platform

You can search The Platform for Listings by using Your desired location. Dates, tags and categories. You can then make use of the various filters offered to refine the search results to Your exact desire. Search results are based on their relevance to Your search and other criteria. Relevance considers factors like location, dates, tags, categories, price, availability, reviews, customer service, popularity, Your previous orders and favourite Listings, Chef validation, and more.

All prices displayed are subject to change without prior notice and should be used only as guidelines. The Total Price can only be calculated and accurately displayed at checkout.

5. Ordering on The Platform

When You order a Listing, You are agreeing to pay all the charges for Your order as indicated by the Listing’s price, any possible Extras You may have selected, if so offered, and the applicable Service Fees, taxes, and any other items identified during checkout. When You receive the order confirmation, a contract for the delivery of the Listing is formed directly between You and the Chef. In addition to Our Terms and Policies, You will be subject to and responsible for complying with any supplemental or additional terms that apply to the Listing offered, including, but not limited to, any other rules, standards, policies, and/or requirements identified in the Listing or during Your checkout on The Platform that apply to Your order. It is Your responsibility to read and understand these rules, standards, policies, and/or requirements prior to ordering Listings. Be aware that some Chefs may work with a co-chef or as part of a team to be able to provide some of the Listings offered.

The Company does not own, control, or manage any of the Listings on The Platform. Any orders for Listings placed by You on The Platform are done for You by The Company with a third-party (Chef). The Company is not a party to the contract entered into directly between You and the Chef. Any rights of recourse that You may have regarding a Listing obtained on The Platform are directly with the Chef.

6. Listing Terms

Each Listing on The Platform may have supplemental or additional terms disclosed in the Listing’s description by the Chef offering such listing that apply to Your order. It is Your responsibility to familiarise yourself with these terms of the Listing before completing Your order.

7. Order Cancellations

When an order has been placed on The Platform and the payment has been finalised by the Payment Aggregator, there is no form of cancellation on The Platform, as The Platform holds no monies in clearing accounts. Once a transaction has been finalised, the funds are instantly transferred to the Chef’s account by the Payment Aggregator.

8. Failure to Collect

It is solely Your responsibility to ensure collection of Your order from the specified location during the specified collection window times. In many cases, Order collection postponement may not be possible as some Listings could contain fresh produce that cannot be stored.

Should You fail to collect for whatever reason, there will be no refunds payable to You, so all costs involved will be for Your own account.

9. Payments

All payments on The Platform are handled by a Payment Aggregator.

10. User Terms and Conditions of Service Enforcement and Contact Details

If, for some reason, You believe We have not adhered to the principals stated in the Terms and Policies or have any queries regarding them, You may notify or contact Us via the Policies & Violation form on the Contact Us page, or by emailing Us directly at Policies@Munchies4U.co.za.
